The regulations state that “a PCBU with management or control of a workplace who knows or ought reasonably to know that there is a risk of exposure to respirable asbestos fibres in the workplace must ensure, so far as is reasonably practicable, that all asbestos or ACM giving rise to the risk at the workplace is identified.”
Therefore, for any commercial property that is leased where the age of the building is prior to 2000, you are required by legislation to identify and manage asbestos. Failing to comply with current regulations is an offence and is liable for conviction. An individual will receive a fine no more than $10,000 and for any other person, a fine not exceeding $50,000.
